Terms & Conditions

Apex Wireless reserves exclusive right to suspend or terminate the subscribed line due to a late payment, payment failure, or default on behalf of your employer.

Payment Invoices will be emailed five days prior to payment run (autopay) and declined payments will receive a 21-day grace period before services will be suspended. Once payment is received, it can take up to 24 hours for services to be reconnected, additionally, a $25 reconnection fee will be applied to the following month’s invoice. After 31-days of non-payment, numbers will be canceled, and any applicable fees will be applied to the final invoice and sent for collections.

Contract Plan The contract term is depending on the options made available by your employer. Full Retail and BYOD rate plans have no contract, and you may cancel at any time with no cancellation fees.

Enrollment Fee A $30 per line enrollment fee will be billed and must be paid prior to service activation and equipment shipments.

A $5 administrative fee per month, per line, plus tax, will be charged.

Your employer is not responsible for the carrier service quality or service interruptions.

 

Temporary Number Activation and Number Porting with Apex/T-Mobile

 

These Terms and Conditions ("Agreement") govern the activation of T-Mobile services using a temporary phone number and the subsequent porting of an existing number to replace the temporary number. By activating T-Mobile services, you ("Customer") agree to abide by the following terms:

 

Temporary Number Activation:

Temporary Number: T-Mobile will assign a temporary phone number to Customer when activating services. This temporary number is provided to facilitate the initial setup and activation of T-Mobile services.

Service Activation: Invoicing for T-Mobile services will begin at the time when the temporary phone number is activated on the Customer's device or SIM card.

Usage of Temporary Number: Customer acknowledges that the temporary number provided by T-Mobile is for temporary use only and may be subject to change when the Customer proceeds with the number porting process. Customer understands that Apex/T-Mobile cannot guarantee the retention of the temporary number once the number porting process has been initiated.

 

Number Porting:

Number Porting Process: Customer has the option to port an existing phone number to replace the temporary number. To initiate the number porting process, Customer must follow the prescribed process as outlined by Apex/T-Mobile.

Responsibility: Customer is solely responsible for ensuring that the number to be ported is eligible for porting and that all necessary documentation and information required for the porting process are accurate and complete.

Porting Timeframe: The duration of the number porting process may vary depending on various factors, including but not limited to the cooperation of the previous service provider. Apex/T-Mobile will make reasonable efforts to expedite the process, but Customer acknowledges that delays may occur.

Temporary Number Discontinuation: Once the number porting process is successfully completed, the temporary number assigned to Customer will be discontinued, and the ported number will replace it as the primary number associated with Customer's T-Mobile service.

 

Billing and Charges:

Billing Commencement: As previously mentioned, invoicing for T-Mobile services will begin at the time when the temporary number is activated. Customer will be billed based on the selected service plan and any applicable fees.

 

General Terms:

Changes to Terms: Apex/T-Mobile reserves the right to modify these Terms and Conditions at any time.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where the T-Mobile service is provided.

By activating T-Mobile services with a temporary number and initiating the number porting process, Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions. Failure to comply with these terms may result in the termination of T-Mobile services.

 

​Unlocked Devices If you are participating in a rate plan which offers a discounted device, said device will not be “unlocked” or “owned” by you until a subsidy has been fulfilled on that line. In order to bring your device to another carrier within a 24-month period, you may need to pay the difference in discounts previously received in order to unlock the device early.

Support All billing questions will be directed to Apex Wireless; this includes but is not limited to change of payment method, billing questions, termination requests, orders for new or additional lines of service, or replacement hardware devices.

USE OF PERSONAL INFORMATION

We use your personal information for a variety of purposes, including providing you with services. We use your personal information for the following reasons:

•         Process your orders.

•         Respond to legal processes and emergencies.

•         Develop or inform you of new products and services.

INFORMATION WE SHARE

We may share information that is anonymized or in an aggregated form that does not directly identify you. We do not share your personal information with third parties:

Group Account Holders We offer group accounts to business and government customers, family customers and other group account holders (“Group Accounts”). The account holder for Group Accounts is the entity or person that buys the service or product for its employees, family members, or other authorized users. You (as the user of a device) may receive service, certain pricing, terms, or other benefits through a Group Account with us. If so, we may share with that Group Account holder customer registration and other information related to your account.

Protection of Apex Wireless and others We may access, monitor, use or disclose your personal information or communications for the following reasons:

Comply with the law or respond to lawful requests or legal process; protect the rights or property of us, our agents, members, our customers, and others including enforcing our agreements, policies, and terms of use respond to emergencies; initiate, render, bill, and collect for services; or facilitate or verify the appropriate calculation of taxes, fees, or other obligations due to a local, state, or federal government requirement; or determine eligibility for government benefits.

 

NETWORK AND INFORMATION SECURITY

We maintain a variety of physical, electronic, and procedural safeguards. These safeguards help protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.

UPDATING THIS POLICY

This policy may change from time to time and the current policy will always be maintained within the Selfcare Portal where you pay for your monthly service.

EMPLOYMENT TERMINATION

•         In the event my employment is terminated, I understand I have the right to transfer my Mobile number(s) to a personally liable account with T-Mobile at no additional charge. I understand that if I do not comply within 30 days of the termination date that my mobile phone number(s) may be subject to cancellation at that time.

•         I understand if I do not transfer my mobile phone number(s) within the specified timeframe of 30 days from my employment termination date the I will return my devices to Apex Wireless at no additional cost.

•         I understand my employer reserves the right not to transfer my numbers in an event of fraud or any other unlawful acts in accordance with state and federal law

Unlimited for Phones includes unlimited talk, text, and data on our advanced network with no data overages. You can also call, text, and use up to 5GB of 4G LTE data in Mexico and Canada at no extra charge. You get unlimited text and 2G data roaming in more than 210 countries and destinations, unlimited domestic data roaming and unlimited video streaming at DVD quality, 11GB of 4G LTE hotspot data (with unlimited max 3G hotspot speeds thereafter), free texting and a free hour of Wi-Fi on Gogo-enabled flights—all included at no extra charge.

During congestion, a small fraction of customers using >50GB/mo. may notice reduced speeds until next bill cycle due to data prioritization. Video typically streams on smartphone/tablet at DVD quality (480p) unless you add an HD Day Pass. Coverage is not available in some areas. Subsidy plans include part or all of the cost of a phone in the monthly charge, and a two-year service agreement is required. If you cancel service, you may be charged a subsidy repayment (1/20th of subsidy per month remaining).
